Specific Terms and Conditions for Paintings on Canvas

These terms and conditions do not affect your statutory rights

Only persons aged eighteen years or over may agree to these terms and use the web site or the services offered through the web site.
We may modify these terms at any time. We will post the modified terms on the web site. The modified terms will come into effect as soon as they are posted on the web site and use of the web site (or of any services provided through the web site) after that point will be subject to the modified terms.

Payment:
After an artwork is commissioned you will be informed of the estimated completion date and given a fixed cost that will include VAT and the shipping charges. Before any work commences on an artwork we will ask for a 20% deposit. A full payment of the balance and shipping charges will be requested when we have finished your painting. When this final balance has reached us and cleared we will send out the finished artwork.

Delivery:
Delivery costs will vary depending on the final size and destination of the artwork. This cost will be made clear at the point of ordering. Delivery will be provided for by specialist couriers and they may require for someone to be present to sign and collect the artwork. It is the sole responsibilty of the customer to ensure that someone is available to take delivery and The Big Art Company cannot be held responsible for any late, lost or unforseable event caused by a delivery not being met. You shall be deemed to have accepted the goods 3 days after receiving delivery.

Returns:
The Big Art Company will accept returns at any time before the goods are deemed to have been accepted (3 days after delivery). We will not accept returns without prior agreement. On receipt of the returned item in "as new" condition The Big Art Company will fully refund all cleared payments and reimburse all delivery charges. The artwork will then be deemed to be owned by The Big Art Company.

Copyright:
It is the sole responsibility of the customer to ensure that any image that they present for transformation into an artwork is copyright free or that the copyright is owned by the customer themselves. The Big Art Company will take no responsibility for any breach of copyright caused through painting or printing an image supplied by a customer.

Privacy Policy:
Whilst The Big Art Company will need to take certain personal details such as contact and delivery information we will never pass this information over to any 3rd party (except for the needs of product delivery). All personal information will be kept in a secure environment and not be accessible via the internet. The Big Art Company does retain the right to use photos of your painting as examples on the site. If you would not like you artwork displayed please contact us and we will remove it.

This site contains links to other sites. We cannot be responsible for the privacy policies and practices of other web sites. We recommend that you check the policy of each site that you visit.

What you cannot do:
You are not allowed to copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained in the web site except as set out under “what you are allowed to do”
You are not allowed to upload, email to us or order prints of any images or other material which contain:
nudity or pornographic or obscene material;
racist material;
material that is likely to incite hatred against any person or group;
blasphemous material;
defamatory or otherwise actionable material;
images of any criminal act;
material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party;
material that breaches any applicable laws or legislation

Law and jurisdiction
These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with English law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the English courts will have exclusive jurisdiction over such dispute.

Specific Terms and Conditions for Photographic printing on canvas

Introduction

This service is provided by Kanvas Studios with whom The Big Art Company are affiliates

Artwork supplied
The Big Art Company cannot warranty the final outcome of a print if the artwork you supply is of inferior quality or not suitable for a print size required by you. We will do our best to give you a quality finish but we cannot be held responsible for the end product if your supplied artwork is poor. It is your responsibility to ensure that all colours, sizes and cropping areas are indicated and where necessary corrected. The Big Art Company can work on sub-standard images or photos only if asked by you and subject to the rates below. The Big Art Company will print works exactly as supplied by you unless otherwise requested.

Copyright
The copyright in all works supplied by The Big Art Company will remain with The Big Art Company or the relevant artist or photographer.

By supplying us with artwork, you warrant that you have the copyright or licence in that image or the written permission of the copyright owner to use the photograph. Under no circumstances will The Big Art Company be responsible for any copyright issues arising as a result of you supplying us with any image or artwork in breach of copyright.

Right to refuse
The Big Art Company hold the right to refuse work which is deemed of very low quality or in contradiction with our business morals and principles. This may include but is not limited to: poor artwork, immoral or illegal materials.

Availability
The Big Art Company have most advertised materials in stock at all times. We reserve the right to substitute materials for an equal or better one if the need arises.

Prices
The Big Art Company prices are competitive, however we reserve the right to alter these without notice.

Payments
The Big Art Company do not operate a credit facility. All orders of products need to be paid for up front. All services will require a 50% deposit, the remainder to be paid on the day of completion.

The work
The Big Art Company carry out in-house work. However, we reserve the right to sub-contract your work if we deem it suitable or necessary.

Cancellations
The Big Art Company cannot cancel works which have been initiated and paid for.

Refund
The Big Art Company will only Refund within 24 hours of ordering

Additional work
All works supplied to The Big Art Company must be "print ready". Any additional work that has to be done by The Big Art Company will be charged at £50 per hour with a minimum charge of £20.

The completed work
The Big Art Company will do their best to give you a product as close to your request as possible. However, under no circumstances will The Big Art Company be responsible for colour-matching. Our discretion is final.

Delivery
We will do out best to deliver your products in the quickest possible time without sacrificing quality. The Big Art Company do not have any control over Royal Mail or courier companies. Some deliveries may be delayed due to your location, accidents or local disruptions. In these instances, The Big Art Company will not be liable for any consequential loss. Please ensure that you CHECK your delivery before signing for it. The Big Art Company will not accept liability for missing or damaged items unless this is brought to the attention of the delivery company. Please do not sign for your goods until you have physically checked them and are satisfied that they are in perfect condition.

Loss or damage
The Big Art Company shall not be responsible for any loss or damage to your product during transport beyond the value of the invoice and what you have paid us.

Guarantee
The Big Art Company will give you an 80 year original guarantee with all works which have been laminated by us. This guarantee entitles you to a replacement product should it display a fault. Please note that the The Big Art Company' guarantee does not cover loss, accidental damage, wear and tear or the work being subjected to anything unusual. All works must be kept in a cool ventilated place away from direct sunlight, extreme temperatures and extreme environments. The final say with regards to the validity of your guarantee lays completely with The Big Art Company.

Discrepancies
Any discrepancies in the final work delivered to you must be reported to The Big Art Company within 24 hours of receipt.

Purchasing
By making a purchase from The Big Art Company, you agree to allow The Big Art Company to showcase or feature your work on their web site or any other related web sites or in promotional literature.

Part-handled works
The Big Art Company cannot warranty any works which did not originate and complete entirely at The Big Art Company. In other words, we cannot warranty the quality of a print which was done elsewhere but laminated by us.

Canavas sizes - End product
Please note that the sizes selected and ordered are actual "canvas" sizes. In other words, if you order a canvas stretched 20 x 20 inches, the final work will be 16 x 16 inches stretched. i.e. 2 inches would go around the edge of the canvas all around. If you would like a 20 x 20 inch canvas stretched, then you need to order a 24 x 24 inch canvas.

If you are ordering a wraparound canvas, then you need to allow for 2 inches all round. i.e If you would like a wraparound 20 x 20 inches as a final product, then you need to order 24 x 24 inches. If you order 20 x 20 inches, you will end up with a canvas which on the frontal aspect is only 16 x 16 inches.
